We at GROHE appreciate your interest in our company, our products and our services. The protection of your privacy when using our offers is of particular concern to us. Therefore, we are pleased to inform you in this data protection declaration about the processing of your personal data in connection with our "Augmented Reality Application" for mobile end devices (" AR App").

A. Responsible for data processing

The controller for the processing of personal data in the context of the use of the AR App in accordance with the provisions of the Datenschutzgrundverordnung (DSGVO) is:

B. Data processing

We process various data within the scope of using the AR app. Further details, in particular on the processing purposes and the applicable legal basis, are listed below:

a) Use of the AR app as a virtual planning tool.

If you use the AR app, you can film your surroundings with the help of the camera integrated in your end device and virtually insert the products from our range there. Depending on which objects or in which environment you are filming, you may capture video images with the camera that contain personal data (e.g. photos of people or personal documents recognisable in the environment).

The respective video images are only captured during the respective usage process and are temporarily stored locally in the RAM of your end device. When you close the AR app, all projects and data are automatically deleted. The video images are not transferred to us or third parties. Accordingly, we do not process any personal data when you use the AR app as a virtual planning tool.

b) Contacting us

If you contact us via the communication channels provided in the AR app (e.g. by e-mail), we process your contact data (e.g. e-mail address, name) and the other data you provide exclusively for the purpose of processing and handling your enquiry. We process your personal data on the basis of Art. 6 (1) f) DSGVO. Our legitimate interest in processing the data is to properly respond to your enquiry.

C. Data transfer and duration of data storage

If you use the AR app as a virtual planning tool, the video images captured by the camera will only be temporarily stored locally on your end device. There is no transmission to us or third parties. When you close the AR app, all data stored by the AR app is automatically deleted.

If you contact us via the communication channels provided, your data will be stored in our IT systems. Depending on which communication channel you use, we use systems provided by external technical IT service providers (telecommunications and hosting providers). The technical IT service providers we use process your personal data exclusively on our behalf and in accordance with our instructions as order processors. We only store the data you provide to us as part of a contact enquiry for as long as is necessary to process your enquiry. Insofar as statutory retention obligations must be observed, the storage period can be up to 10 years, regardless of the processing purposes.

D. Your data subject rights

a) Information

Upon request, we will provide you at any time and free of charge with information about all personal data that we have stored about you. You can also request a copy of your personal data. Further details on your right to information are set out in Art. 16 ff. DSGVO.

For your own protection, we reserve the right, in the event of a request, to obtain further information necessary to confirm your identity in order to prevent unauthorised persons from gaining access to personal data that we are committed to protecting. If identification is not possible, we reserve the right to refuse to process the request.

b) Correction, deletion, restriction of processing (blocking)

If you no longer agree to the storage of your personal data or if this data has become incorrect, we will arrange for the deletion or blocking of your data or make the necessary corrections (insofar as this is possible under the applicable law) in response to a corresponding instruction. The same applies if we are only to process data in a restrictive manner in the future. Further details on rectification, erasure and restriction of processing are set out in Art. 16 ff. DSGVO.

c) Data portability

Upon request, we will provide you with your data in a common, structured and machine-readable format so that you can transfer the data to another data controller if you wish. More detailed provisions are contained in Art. 20 DSGVO.

d) Right of objection

In accordance with Art. 21 DSGVO, you have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data relating to you which is carried out on the basis of Article 6(1)(f) of the DSGVO (processing of data on the basis of a balance of interests).

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

The objection can be made without any formalities and should, if possible, be addressed to the office mentioned in the data protection statement under section A.

e) Right of appeal

You have the right to lodge a complaint with a data protection supervisory authority if you believe that the processing of your personal data is not lawful. The right of appeal is without prejudice to any other administrative or judicial remedy. f) Exercise of your data subject rights

E. Changes to the data protection information

In order to ensure that our data protection information always complies with the current legal requirements, we reserve the right to make changes at any time. This also applies in the event that the data protection information has to be adapted due to new or revised offers or services.
